What an SPI licence is, and why you need it

A company that wants to work in the financial sector of a given country’s market needs a licence there. Every country has licences for non-credit financial institutions that cover all the activities they might carry on, payment transactions included.

In Poland, a small company that offers a limited range of services, and does not need full authorisation as a payment institution, must hold an SPI (Small Payment Institution) licence to run a payment system legally. Without the licence, it cannot process, store or transmit data.

SPIs have to be registered with the Polish Financial Supervision Commission (Komisja Nadzoru Finansowego, KNF, in Polish). The licence shows that the organisation meets set standards and requirements, which protect the stability and integrity of the financial services sector.

Nimius Advisory gives professional help with preparing and filing an SPI licence application in Poland, and our specialists have long experience of work like this. If you are still deciding where to register a small payment organisation, or have other questions, we will tell you which way to go to reach your goal.

Who can apply for an SPI licence in Poland

An applicant company has to meet these conditions:

  • Its payment transactions average no more than EUR 1,500,000 a month. Above that, it no longer counts as a Polish Small Payment Institution: it has to become an API (Authorised Payment Institution), with different capital requirements.
  • It offers no payment initiation or account information services.
  • Its managers, or whoever is responsible for running the business, have an economic or financial background and a good reputation, with no convictions for money laundering, terrorist financing or any other financial-sector offence.
  • Its office is registered in Poland.
  • Its top management includes residents of Poland, not just foreign nationals.

Bear in mind that the full set of documents for an SPI licence takes serious preparation. You will need extracts from the company register and papers describing the organisational structure, with details of, among other things:

  • bank accounts;
  • processing centres;
  • settlement banks, etc.

The applicant should also say which payment instruments it plans to use to transfer money.

Our experts help you gather every document Polish law requires, and we check that your company’s activities meet the applicable regulations and requirements. With us, you can be certain of a quick and successful licensing procedure.

What an SPI licence in Poland allows

Holding the licence, you may provide these services:

  • Cash deposits into a payment account
  • Cash withdrawals from the payment account
  • Transactions, including transfers of funds to the user’s payment account
